At the time of his death, Mr. Lombard, with his wife, had been some months visiting with his daughter and son-in-law, Mr. and Mrs. George Schmidt, of this city. Mr. Lombard died in the Christian faith, and the funeral services were conducted by Rev. M.J. Ballantyne. The remains were interred in the Masonic cemetery. on 3 April 1891 at Corvallis, Benton County, OR, USA.14

Joseph Button of Wells in said District having presented into court, an instrument in writing, purporting to be the last will & testament of Benjamin Lumbard, late of said Wells deceased, and having notified all persons concerned, as the law directs under an order of said Court that the same would be examined at said Castleton at the time above mentioned, and having produced two of the subscribing witnesses to said will, who being duly sworn testify today, that they saw said deceased when in life sign & seal said instrument & heard him declare the same to be his last will & testament, and that at the time of executing said instrument the said deceased appeared to them of sound & disposing mind & memory & that they subscribed their names to said instrument in the presence & at the request of the said deceased and in the presence of each other. Wherfore, it is decreed that said instrument was duly executed as the last will & testament of said deceased, and as such is proved, approved & allowed, & ordered to be recorded as follows, to wit.
In the name of God, amen; I Benjamin, Lumbard, of Wells in the county of Rutland & State of Vermont, being weak in body, but of sound & perfect mind & memory, do make & publish this my last will & testament in manner & form following that is today. I will that all my debts & funeral charges be paid by my Executor, hereafter to be mentioned. I give to my four sons, Alvin, Ebenezer, Joseph & Benjamin after my decease, all my wearing apparal, to be equally divided between them. I give to my daughter Bethiah Hopson, one dollar to be paid after my decease. I give to my adopted daughter Anna Fisk twenty five dollars, and one two year old brindle line back Heifer, and all the remainder of my estate both real & personal, I give to my dear & beloved wife Patience Lumbard, and furthermore I hereby appoint Joseph Button of said Wells, sole Executor of this my last will & testament, hereby revoking all former wills by me made. In witness whereof I do hereunto set my hand and seal this 30th day of May in the year of our Lord 1822.

Joseph Button the Executor named in the last will and testament of Benjamin Lumbard late of Wells in said district deceased, accepted the trust & gave bonds in the sum of one thousand dollars, Samuel S. Merriman Surety.

     John Pray & Josiah Goodspeed of Wells in said district; were & are hereby [co. stitaled] & appointed a committee to appraise the estate of Benjamin Lumbard late of Wells deceased, & directed to return an inventory of said estate, with their appraisal on oath by the 1st Monday of November next & commissioned accordingly.

The Executor of Benjamin Lumbard late of Wells in said district deceased is ordered to notify the creditors to the estate of said deceased, by publication three weeks successively in the Rutland Herald, and by posting up notifications at Fitch's store & at R. Smith's Inn in Pawlet, and at Graves & at Blossom's in Wells, to exhibit their claims to said Executor within one year or their claims will be forever barred.

You are hereby directed to notify and require all persons having demands against the estate of said deceased, by publication of this order three weeks successively in the Rutland Herald, and by posting the same at Fitch's store and at Smith's inn, in Pawlet, and at Graves' inn and Blossom's inn in Wells, in said district, within sixty days, to exhibit said demands to you within one year from the date hereof, and all claims not presented within the time aforesaid, shall be for ever barred.

"Lumbard, Benjamin, (by A. Lewis, Esq.) married Patience Goodspeed, in Barnstable Mass; they had seven children. all born at that place; in 1797 they moved to Wells; the names of their children were: Alvin, who married Sarah Culver; Bethiah married Levi Lewis; Olive and Anna both died young; Ebenezer married Pamela McClure; Joseph married Betsey Malory; Benjamin married Lucinda Tyler. Some of the grand-children are now living in Wells." in 1869.2
