Be it Remembered, That heretofore, to wit: on the 9th day of Oct in the year of our Lord one thousand eight hundred and 76 James Clark Executor named in the Last Will and Testament of Durus Lumbard late of the town of Richland in the County of Oswego deceased, appeared in open Court, before the Surrogate of the County of Oswego and made application to have the said Last Will and Testament which relates to both real and Personal Estate proved; and on such application, the said Surrogate did ascertain by satisfactory evidence who were the heirs at law and next of kin of the said testator, and the respective residences, and said Surrogate did thereupon issue a Citation in due form of law, directed to the heirs at law, and next of kin by their respective names, stating their respective places of residence requiring them to appear before said Surrogate at his office in the village of Mexico in said county, on the 20 day of Oct A.D. 1876 to attend the Probate of said Will.
And afterwards, to wit; on the 26 day of Dec A.D. 1876 satisfactory evidence by affidavit, was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law, and on that day no one appearing to oppose the Probate of such Will such proceedings was thereupon, had in said Court afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth, upon this 26 day of Dec A.D. 1876 and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament and proofs are as follows, that is to say:

In the name of God Amen. I Durus Lumbard of the town of Watertown Jefferson County N.Y. being of sound mind and memory do make publish and declare this my last will and testament in manner following.
First. My executor shall pay all my just debts and funeral expenses and he is hereby directed to pay John A. Howard his reasonable charges for board, lodging, nursing & doctors bill for me from the 9th day of May 1876 until my decease the same being still unsettled. He is also directed to procure a suitable gravestone for me.
Second: I give and devise to Eliza D. Stoddard of Pulaski, N.Y. my home and lot situate in the village of Pulaski, N.Y.
Third. I give and bequeath to my son Smith F. Lumbard my ($100) town bond of the town of Richland, the cupons attached thereto and the money due and to grow due thereon said bond being numbered 142. I give and bequeath to my grandchild Cora Lumbard my ($100) town bond of the town of Richland No. 143. The cupons attached thereto and the money due and to grow due thereon. I give and bequeath to my grand child Winfield Lumbard my ($100) town bond of the town of Richland No. 141 and the cupons attached thereto and the money due and to grow due thereon. I give and bequeath to the said Eliza C. Stoddard my town bond of ($100) No. 144 and the cupons attached thereto and the money due and to grow due thereon.
Fourth. I give devise and bequeath all the rest and residue of my property of every kind and description to the said Eliza C. Stoddard of Pulaski.
I hereby appoint James A. Clark of Pulaski the executor of this my last will and testament. Witness my hand and seal this 9th day of Sept. 1876.
